What Information About You Do We Collect?
As you use Merci, we collect certain information about you and the services you use. The information we collect falls into three different categories: (1) information you give us; (2) information we collect from you automatically when you use Merci; and (3) information we collect from other sources. In some cases, if you choose not to provide us with requested information, you may not be able to access or use Merci or certain functions or features.
Information You Give Us
If you register as a Merci user, you may be asked to provide and we may collect any of the following information:
- Identification Information – your name, login name, password, email address, telephone number, demographic information, and other information you choose to give us.
- Account Information – text-enabled cellular/wireless telephone number, profile picture/avatar, job title, job location, store location where you work.
To help us provide a secure service we may require additional information from you before permitting you to use Merci so we can verify your identity, address or other information, or to manage risk and compliance throughout our relationship. We also may ask for certain personal information from you for the purpose of providing to you content and/or services that you request. For example, we may solicit customer feedback regarding Merci so that we can improve our service or share information about other products and services that may be of interest to you. We also request your name and e-mail address each time you contact us by clicking on the “Contact Us” link. If you contact us to with questions or to report problems or inappropriate actions of others we may keep records of the information you provide.
Information We Collect Automatically
Cookies/ Web server logs: Our Website utilizes standard technology called “cookies” and web server logs to collect information about how our Website is used. Cookies are a feature of web browser software that allows web servers to recognize the computer used to access a website. Cookies are small pieces of data that are stored by a user’s web browser on the user’s hard drive. Information gathered through cookies and web server logs may include the date and time of visits, the pages viewed, time spent at our Website, and the websites visited just before and just after our Website. This information is collected on an aggregate basis. None of this information is associated with you as an individual. You can, of course, disable cookies on your computer by indicating this in the preferences or options menus in your browser. However, it is possible that some parts of our Website will not operate correctly if you disable cookies. You should consult with your browser’s provider/manufacturer if you have any questions regarding disabling cookies.
Device information: We also may obtain information about you from your mobile device, tablet or computer, such as your device type, geo-location, time zone, language setting, browser type, operating system, and IP address.
Merci usage: We may collect information regarding the frequency that you use Merci; the location, day and time when you use Merci; the frequency of your usage of Merci; the type and amount of data you transmit and receive through Merci; comments, reviews, images and videos you transmit and receive through Merci with users; and information (including, data, images and video) you choose to distribute to social media through Merci.
Information We Collect From Other Sources
We also collect information that is publicly available. For example, we may collect information (including, data, images and video) you submit to a blog, a chat room, or a social network. We may also collect information about you from other companies and organizations for purposes of transaction processing, identity verification, fraud detection or prevention and other similar purposes.
Do-Not-Track Signals and Similar Mechanisms
Some web browsers may transmit “do-not-track” signals to websites with which the browser communicates. Our Website does not currently respond to these “do-not-track” signals.
How Do We Use the Information We Collect?
We use personally identifiable information about you to verify your identity; to help detect or prevent fraud; to respond to your customer service inquiries, reports of problems or inappropriate actions, or requests for information; to maintain and improve Merci and the service we offer; to detect, prevent or investigate security breaches; and, to the extent necessary, to route and transmit other comments and data (i.e., videos, photos or graphics) you send or receive using Merci, including those you wish to share to social media. We also use personally identifiable information to provide you with the information or content that you have requested, and, in some cases, to contact you about our programs, products, features or services. We may use some of personally identifiable information solely, or in connection with, non-identifying information to suggest merchants or services that may be of interest to you.
We use non-identifying information collected through Merci in the aggregate to better understand your use of Merci and to enhance your enjoyment and experience. For example, we may use the information to improve the design and content of our Website or App or to analyze the programs and services that we offer.
How Do We Share the Information We Collect?
We may provide access to your personally identifiable information when legally required to do so; to cooperate with police investigations or other legal proceedings; to protect against misuse or unauthorized use of Merci; to limit our legal liability and protect our rights; or to protect the rights and safety of visitors to the Website, users of the App, or the public. In those instances, the information is provided only for that limited purpose.
If we become involved with a merger or another situation involving the transfer of some or all of our business assets, we may share your information with business entities or people involved in the negotiation or transfer.
We may disclose your information if we believe that the disclosure is necessary to enforce our agreements or policies, or if we believe that the disclosure will help us protect the rights, property, or safety of TipQuik, Inc. or our users or business partners.
We also may share information about you with other companies if you direct us to share the information, including by using certain features of Merci.
We may share your information in a way that does or does not directly identify you. For example, we may combine information about you with information about other people and share the combined information in a way that does or does not link your information to you.
If we offer a publicly accessible place for you to post information on a blog, social media accounts, or another part of our Website or App, the information that you post may be seen by other visitors to our Website or other users of the App, including your post information, your profile name, your profile picture/avatar, your login name or other identifier that you use. All personal information is kept private from other individualusers (which does not include our business partners, referenced above) of the App. The only identifier to your Merci account, in order to give/receive with other Merci users inside the App, is your First Name, your Last Name, and a Profile Picture/Avatar that you choose to use. Users can voluntarily include their job title and the name of their work location, marked“Where do you work?”in the profile page of the app, if they like to complete their profile and be better recognized by other users trying to review them. In addition, we have further options to keep yourself completely anonymous when giving a review to other users of the app if you choose to not share your Profile Picture/Avatar, First Name and Last Name. If a user keeps their settings as anonymous, Company will still be able to see the full details of each user as well as all the details provided in a Give and Receive post. If you volunteer to share any personal information in your posts, review, photo or video that you create, you acknowledge that you have given up your right to privacy, and Company is not responsible for your release of your information.
If you use Merci to provide or receive feedback to/from other users and/or businesses, the information you provide and any identifying information about you that you include in such feedback may be shared with the other users and/or businesses and/or on Merci’s social media channels, media and print advertisements, websites and emails and/or your place of employment that you list on your profile page in the field marked “Where do you work?”You acknowledge that you have given up your right to privacy, and Company is not responsible for your release of your information. However, if a review is given anonymously, only the details included in the review may be shared. If a review is given anonymously, no personal identifying information will be shared.
How Do You Access And/Or Modify Your Information or Choices?
If you visit or use Merci/Merci360 and provide personally identifiable information, you can not modify, update or delete such information by making changes directly in the App. To make any changes to any of the personally identifiable information, you must contact Merci at email@example.com. Please be aware that if you delete certain information you may not be able to use Merci. You should be aware, however, that it is not always possible to completely remove or modify information in our databases.
Privacy Protections for Children Using the Internet
For that reason, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal or payment information to us through the App, Website or Service. If we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.
We take reasonable steps to maintain the security of the personally identifiable information that we collect, including limiting the number of people who have physical access to our database servers, as well as installing electronic security systems that guard against unauthorized access. When you transmit highly sensitive information through our Website or in our App, we encrypt the transmission of that information using standard practices and procedures. However, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk.
If you are a California resident, you can request a notice disclosing the categories of personal information we have shared with third parties for the third parties’ direct marketing purposes.
